1. Acceptance of Terms

By accessing or using TraceNode Lite ("the Service"), you ("the Operator") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all operators who create an account through the registration process at /register.

These Terms supersede all prior agreements, representations, and understandings relating to the Service.

2. Service Description

TraceNode Lite provides a dispute management and compliance platform for licensed gambling operators, including:

The Service is provided as-is. Supported jurisdictions currently include UKGC, MGA, Gibraltar, Isle of Man, Alderney, Curaçao, Sweden, Denmark, Spain, Ontario (AGCO), Nevada (NGC), New Jersey (DGE), Pennsylvania (PGCB), Michigan (MGCB), West Virginia (WVL), Illinois (IGB), Colorado (CLGCC), and Indiana (IGC).

3. Eligibility & Registration

You must be a licensed gambling operator, or an authorised representative of a licensed operator, to create an account. By registering, you represent and warrant that:

Accounts are subject to review and may be suspended where we reasonably believe the account is being used in violation of these Terms or applicable law.

5. Compliance Responsibilities

TraceNode Lite is a tool — it does not guarantee regulatory compliance on your behalf. You are solely responsible for:

TraceNode Lite accepts no liability for regulatory penalties, sanctions, or licence consequences arising from your failure to comply with applicable requirements.

6. Data Handling & Privacy

Dispute data, player information, and audit records submitted through TraceNode Lite are stored in a Postgres database managed by Polsia on behalf of the operator. Data is retained for as long as your account is active and may be deleted within 90 days of account closure.

The operator retains ownership of all dispute and player data submitted through the Service. TraceNode Lite does not use operator data to train external AI models or share it with third parties, except as required to deliver the Service (e.g. regulatory report generation).

Regulatory bodies may be granted time-limited, logged access to audit records in accordance with your configured regulator access settings. You retain the right to revoke regulator access at any time via the Settings page.

7. Intellectual Property

The Service, including its design, codebase, documentation, and branding, is the property of TraceNode Corp. or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose only.

You may not copy, modify, reverse-engineer, or resell the Service or its components without prior written consent. You retain ownership of any dispute data and compliance reports you generate through the Service.

8. Service Limitations

TraceNode Lite is provided as a web application with a 99.5% monthly uptime target. The Service may be temporarily unavailable during scheduled maintenance, for which we will provide at least 48 hours' notice where practicable.

We do not guarantee that the Service will be uninterrupted, error-free, or free from data loss. Backups of dispute and audit data are performed daily. You are responsible for maintaining your own copies of critical compliance reports.

The SLA monitoring feature is based on jurisdiction-specific thresholds configured at registration. You are responsible for verifying these thresholds are correct for your licences.

9. Limitation of Liability

To the maximum extent permitted by law, TraceNode Corp., its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or business opportunities, arising from your use of or inability to use the Service.

Our total aggregate liability arising from or related to the Service shall not exceed the total fees paid by you to TraceNode Corp. in the 12 months preceding the claim.

This limitation does not apply to damages arising from gross negligence, wilful misconduct, or fraud, or to death or personal injury caused by our negligence.

10. Termination

Either party may terminate this agreement at any time by providing written notice to the other. Upon termination:

We may suspend or terminate your account immediately if you breach these Terms, provide false information at registration, or engage in activity that threatens the integrity or security of the Service or other operators' data.

11. Changes to Terms

We may update these Terms from time to time to reflect changes in the Service, regulatory requirements, or applicable law. When we make material changes, we will notify you via the email address associated with your account at least 30 days before the changes take effect.

Continued use of the Service after the notice period constitutes acceptance of the updated Terms. If you do not agree to updated Terms, you must cease using the Service before the effective date.
